Divorce and Children

Child custody and access (now known by the courts as child arrangements), is when you decide where the children will live after your separation and how often they will see the other parent. This is decided separately to the divorce.

If you agree the arrangements, there is nothing else you need to do. The court does not need to approve the arrangements. If you like, you can record what you have agreed in a parenting planwhich can help set out your expectations regarding the arrangements.

If you are struggling to agree

If you are struggling to agree the arrangements, then you can apply for a court order. This is called a Child Arrangements Order. There are a number of things you can include in the Child Arrangements Order depending on what you have been able to agree on. For example you can have an order which  states where your child lives, when your child spends time with each parent when and what other types of contact, like phone calls, take place. It is also possible the care to be shared.
